A military judge is deciding whether to dismiss the charges against accused deserter Sgt. Bowe Bergdahl after a bold argument Tuesday from defense lawyers that Sen. John McCain exerted unlawful influence.
Eugene Fidell, a lawyer for Bergdahl, said McCain has meddled with the case to the point that he doesn't believe Bergdahl can receive a fair trial. He asked Col. Jeffery Nance, the military judge overseeing the case, to dismiss the case, or if he won't dismiss, to limit Bergdahl's sentence to no punishment.
